Please read carefully — this document releases legal rights on behalf of you and your minor child.
This Waiver is entered into by the Parent or Legal Guardian ("I," "me," or "my") on behalf of myself and the minor athlete being enrolled ("my child" or the "Participant"), in favor of Finta Futsal and Soccer Development, its owner Lucas Tura Moreira Fagundes, and its coaches, staff, and representatives (collectively, "Finta").
1. Acknowledgment & Assumption of Risk
I acknowledge that futsal and soccer are high-intensity physical activities that involve inherent and other risks, including but not limited to: falls; collisions with other players, equipment, or surfaces; muscle, joint, and bone injuries; weather-related conditions; physical exertion; and, in rare cases, serious injury. I understand these risks cannot be eliminated. I voluntarily accept and assume all such risks on behalf of myself and my child, whether known or unknown.
2. Physical Fitness & Medical Authorization
I warrant that my child is in good physical health and has no medical condition, disability, or injury that would prevent safe participation, and that it is my responsibility to consult a physician before my child begins any physical training program. In the event of an injury or medical emergency and if I cannot be reached, I authorize Finta to arrange or secure necessary medical treatment for my child, and I agree that any costs of such treatment are my sole responsibility.
3. Safety Equipment
I understand that appropriate footwear and safety gear (including shin guards) are required. Finta is not responsible for injuries resulting from failure to wear proper protective equipment or footwear.
4. Release & Waiver of Liability
To the fullest extent permitted by California law, I release, waive, and discharge Finta from any and all liability, claims, demands, or causes of action arising out of or related to any injury, loss, or damage sustained by my child or me in connection with the training, including claims based on Finta's ordinary negligence. This release does not waive liability for gross negligence, recklessness, or willful misconduct, which California law does not permit to be released.
5. Indemnification
I agree to indemnify and hold Finta harmless from claims brought by or on behalf of my child arising from my child's participation, to the extent permitted by law.
6. Parent/Guardian Authority
I represent that I am the parent or legal guardian of the Participant with full authority to enter into this Waiver on the child's behalf, and that I am signing voluntarily.
7. Severability & Governing Law
If any portion of this Waiver is held invalid, the remainder shall continue in full force. This Waiver is governed by the laws of the State of California.
8. Acknowledgment
I have read this Waiver, understand that I am giving up substantial legal rights on behalf of myself and my child, and agree to it freely and voluntarily.
Electronic acceptance: by typing my full legal name and submitting, I sign this Waiver as the parent/legal guardian. The system records my name, the date and time, and my IP address as my electronic signature.
